were examined. Viz.Jacob Ambrose being sworn deposeth and saith he waspresen ton the 26 of Oct. last
at the house of GeorgeEarhart in the county of afsd when David B. Smith waslying in a very low state
of health hit of sound mind andmemory when the said David requested this witness to takenotice that he
wished George Earhart and his wife MaryEarhart the sister of said David to have and possess ashis
heirs all his property he posessed or owned in casehe should die. This deponent some days before heard
thesaid David make similar declarations where in his perfectsenses hit on the above day this deponent
was calledparticular by the said David to take notice in order toprevent disputes -- on the follwing

John Roads was next sworn and stated that on the 25 ofOctober he was at the house of George Earhart when Davidcalled him and requested him to take notice that shouldetc. There people got the estate and George Earhart wasnamed executor. Wilds clerk of the court of common pleaswithin and for the county of Warren aforesaid do hereycertify that the aforegoing will and C is truly takenfrom the records of the court aforesaid.
