This indenture made and entered into this 18th day of March 1870 between Thomas Brierly of the County of Robertson State of Kentucky of the first part, and Sarah Jane McKinzie (late Phillips) wife of Solomon McKinzie, Elizabeth McKinzie (late Phillips) wife of Malcomb McKinzie, Josephine F. Phillips, daughter of Sarah Jane McKinzie and their heirs, and Roean[Roena?], during her natural life time, and at her death her interest to rest in the said Sarah Jane McKinzie, Elizabeth McKinzie and J. F. Phillips their heirs and assigns of the county and state aforesaid parties of the second part. Witnesseth that the said Thomas Brierly for and in consideration of Twenty-five dollars from each of the second parties paid cash in hand, the receipt of which is hereby acknowledged, and the further consideration that the said second parties and to provide for and maintain said first party during his natural life, treat him with humanity, pay all of his doctor bills, and after death inter him with respect, and pay his funeral expenses, and further for the natural affection toward the second parties, have this day bargained and sold, and by these presents do convey, to them their heirs and assigns forever as aforesaid, the following tract of land, situate in the county and state aforesaid, on the waters of Helms run and Little Panther Creek and bounded as follows towit: on the south by the lands of Nimrod Cumber and Wm. T. Cumbess, on the east by that of Peter Linville, on the west by that of John Browning and Austin McDowell, and on the north by that of Elijah Mastin containing 288½ acres more or less. To have and to hold the same hereby conveyed together with all and singular the appurtenances thereunto belonging or in any wise appertaining unto them the said second parties as aforesaid their heirs and assigns forever with covenant of general warranty and the said Thomas Brierly will forever warrant the title to the foregoing described property from the claims of all and any person whatever. I W. M. Chandler Clerk of the County Court for the county in the state aforesaid, certify that the foregoing
conveyance from Thomas Brierly to Sarah Jane McKinzie & others was on the 18th day of March 1870 produced
to me in said county by the grantor, stamped with $3.50 revenue stamp, and acknowledged by him to be his act
and deed, and on this day lodged for record which is done. Given under my hand this 4th day of April 1870.
