mortgage deed

Whereas Mordica McKenzy of the County of Bracken State of Kentucky stands justly indebted to Thomas Galbreath of the county state aforesaid in the sum of fifteen dollars as evidence by his promissory note bearing even date with this mortgage also the said Galbreath is security for said McKinzy to Soloman Orme in the sum of sixty-five dollars as evidenced by a note of this date - and the said McKinzy being desirous of securing said Galbraith in the payment of said debts now executing the following mortgage. Therefore this indenture made and entered into this 23d day of July 1860 between Mordica Mckenzy and Thomas Galbreath of the County Bracken State of Kentucky witnesseth that the said McKenzy for and in consideration of the above premises has granted, bargained and sold unto the said Galbreath the following described personal property viz: One black mare about sixteen years old the same that he purchased of said Ormes, also Two thirds of two acres and one half of tobacco now growing on the land of the said Galbraith and cultivated by the said McKensey to have and to hold the above described personal property to the said Galbraith his heirs and assigns forever, and the said McKenzy hereby warrants and defend the title to the above described property to the said Galbreath his heirs and assigns forever. But it is expressly understood by and between the parties that if the said McKenzy shall well and timely pay off the above indebtedness at or before its maturity then this to be null and void else to remain in full force and virtue. I Rich'd J. Hughey Clerk of the County Court of the County aforesaid do certify that this mortgage from Mordica McKenzy to Thomas Galbreth was this day produced to me in my office by the mortagor and acknowledged by the said Mordica McKenzy to be his act and deed. Whereupon said mortgage together with the foregoing certificate hath been duly admitted to record in my office. Given under my hand this the 23d day of July 1860. Rich'd J. Hughey, clk
