I, John B. Farson, being of sound mind and capable of disposing of my worldly effects and knowing the uncertainty of life and the certainty of death do make this my last will and

testament as follows:

1. After the payment of all my just debts, I will and bequeath to William C. Frayne, son of Richard J. Frayne of Franklin County, Kentucky all real estate to which I may become

entitled in consideration of my services as a private in Company F "22" Regiment Kentucky Volunteers commanded by Col. Daniel W. Lindsey now in the United States service.

2. I will and bequeath to Nancy Marsh, fifty dollars out of my one hundred dollars bounty money which will be due me by reason of my service aforesaid and remaining fifty dollars

of said bounty money. I will bequeath to Nancy Marsh the daughter of the first mentioned Nancy Marsh. With the remainder of my estate consisting of four months pay due me to

the first of March 1862. I desire to be decently interred at Frankfort, Kentucky with an appropriate head and foot stone placed at my grave and should there be any money left after

paying all my funeral expenses, I will and bequeath it to Richard J. Frayne, whom I appoint my Executor to carry out this my last will and testament.

A Writing purporting to be the last will and testament of John B. Farson, deceased with a statement of the deposition of E. S. Fletcher and H. A. Poage was this day produced in

Court and being examined the same is ordered to be recorded , which is done.

Know ye that we trusting in your fidelity and provident circumspection in diligently examining E. S. Fletcher, H. A. Poage and D. K. Weese touching the paper hereto annexed purporting

to be the last will and testament of Jno. B. Farson, which has been offered for probate to the Franklin County Court. We command you at such times and places as you shall appoint

the witnesses aforesaid you shall cause to come before you and then diligently examine an oath touching the premises and their examinations unto our said court is distinctly and plainly

without delay you shall send and certify endorsed returning to us this writ. Witness Alexander H. Rennick, Clerk of our said Court this 26 day of January 1864.

State of Kentucky, Boyd County

The deposition of E. S. Fletcher taken on the 18th day of February 1864 at the Examiners Office in the town of Ashland and state aforesaid in pursuance of the annexed commission. The

despondent being of lawful age and first duly sworn deposeth and saith that he recognizes the will hereto attached purporting to be the last will and testament of Jno. B. Farson as being

in the hand writing of Daniel K. Weese. That he distinctly remembers that upon a certain occasion (time not remembered) the said Weese asked despondent to accompany him to the U. S.

Hospital in the town of Ashland, which he did, and there met a person, to despondent a stranger, but who was called John B. Farson, that the said Farson asked the said D. K. Weese to

read to him the contents of the will hereto annexed, that after reading the same was completed. He impressed his satisfaction as to the statements therein made and declared that to be his

last will and testament, that he then attempted to write his name thereto, but was not able to do so because of his great debility by sickness that he then asked D. K. Weese to write his

name for him (Farson) that after the same had been written by said Weese, he Farson acknowledged it as his act of deed and then requested this despondent H. A. Poage and D. K. Weese

to witness the same. Despondent and the other witnesses then witnessed the said will. Despondent recognizes the signatures of the other witnesses being acquainted with all of them.

Despondent believes the testator John B. Farson to have been in sound mind and of disposing memory though physically very feeble and further despondent saith not.

E. S. Fletcher

Also the deposition of Hugh W. Poage taken at the same time and place and for the same purpose. Despondent being of lawful age and first duly sworn deposeth and saith that he recognizes

the instrument of writing hereto attached as being an instrument to which he attached his signature as a witness at the request of a person in the Hospital at Ashland, who called himself John

B. Farson and who at the same time and place attempted to write his name but was unable to do so, that he Farson then requested D. K. Weese to write his Farson's name for him and after

the same had been written acknowledged it as his act of deed, that he then requested this despondent, E. S. Fletcher and D. K. Weese to sign the same as witnesses which was then done

by each respectively. Despondent recognizes the signatures of the other witnesses being acquainted with all of them. Despondent believes that testator John B. Farson to have been in sound

mind and of disposing memory though physically very feeble and further despondent saith not.

I, A. C. Martin, Examiner within and for the county and state aforesaid duly appointed and sworn, do certify that in pursuant to the commission hereunto annexed on the 18th day of February

1864, I caused to come before me at my office in the town of Ashland and state aforesaid E. S. Fletcher and Hugh A. Poage, persons to me known, who after being first by me duly sworn that

the statements they should make should be th truth the whole truth and nothing but the truth did make the statements to which their names are respectively attached relating to the last will and

testament of John B. Farson, hereto to attached. Given under my hand the 18th day of February 1864.
