In the name of God Amen I James O'Bannon of the County of Franklin and State of Kentucky being in weak and delicate health but of sound mind and disposing memory do

make ordain and constitute my last will and testament. Item 1st I give and bequeath to my beloved wife Maria L. O'Bannon absolutely and unconditionally all the furniture

which she had previous and which has been given her since our intermarriage. Consisting of two bureaus, one bedstead, bed and furniture, one sofa, one piano forte, one large

mirror, chairs tables and other things not now recollected, also all other household and kitchen furniture she may desire to retain. Item 2nd I will and bequeath to my said wife

during her natural life one half of a tract of land lying in Ballard County Kentucky containing about five hundred and forty acres. I also bequeath to my wife during her natural

life one equal undivided interest in the four following negroes towit: Sally, Tom, Flora and Hannah.

Item 3rd I will and bequeath to my beloved daughter Frances M. O'Bannon the remaining half in fee simple of the above described tract of land, and also bequeath to her in fee

simple a tract of land containing one undred (100) acres lying in Marshall Cty. Kentucky. I also bequeath to her in fee simple the remaining undivided interest the four negroes

above mentioned, and at the death of her mother Maria L. O'Bannon, she is to have absolutely the land hereby bequeathed to her mother and also the absolute title control and

possession of said negroes and their increase.

Item 4th I give and bequeath of my beloved wife Maria L. O'Bannon seven hundred dollars in cash. Item 5th After the payment of all debts I may legally owe at the time of my

death I will and bequeath to my beloved daughter Frances M. O'Bannon all the cash & cash notes which may remain on hand amounting to perhaps some two thousand dollars

in cash and one thousand dollars in cash notes which I wish her guardian to invest at interest and securety mortgage or mortgages on valuable real estate such as will be ample

securety both for the payment of interest and principle, the interest to be made payable annually & the principle no longer time than three years. Item 6th I give and bequeath

to my said daughter Frances M. O'Bannon my gold liver watch & chain. Item 7th I give and bequeath to my nephew Elias O'Bannon son of my brother Cuthbert O'Bannon my

present library consisting of law books various library books. Item 8th Whereas Philip Maurous at --- of Paducah, Ky stands justly indebted to me by note in the sum of seven

hundred ($700) I wish and direct that he consider himself as having indulgence for the space of twelve months after my death to pay the same. Lastly I hereby constitute and

appoint the said Philip Maurous Executor of this my last will and testament I having the utmost confidence in his integrity & honesty, request that on the presenting of this my

last will & testament for record the Court will not require Security but permit him to qualify without giving the same.

And I hereby nominate & request the Court to appoint fornlly (sp?) the said Philip Maurous and his wife Elizabeth Maurous Guardians for my infant child Frances M. O'Bannon.

subscribing witnesses thereto & ordered to be recorded whereupon the same is truly recorded in my office.
