I, Joseph Gore of Franklin County make this my last will and testament hereby revolking all former wills and codicils by me heretofore made, viz: I give and bequeath to my wife,

Polly Gore, on third part of my estate real, personal and mixed to her forever to be held in trust during her life by my executor herein after named.

I give and bequeath to Richard Long and Mary Heffner, wife of Nelson Heffner the sum of five hundred dollars each.

I further wish that my executors see that I am properly buried and they have erected around my lot a substantial stone wall and have a nice and substantial marble monument

erected in the center of said lot.

I give and bequeath the remainder of my estate to my heirs.

I constitute and appoint Philip Swigert and H. B. Innes executors of this my last will. In testimony whereof I have hereunto set my hand and seal this 25th day of January 1854.

The motion made on yesterday by Harry B. Innes for the probate of the paper presented by him as the last will and testament of Joseph Gore, deceased and opposed by Philip

Swigert, who claimed that a paper presented by him was the true last will and testament of said deceased, being fully heard and being advised is of opinion that the paper presented

by said Innis is not the true last will and testament of said deceased, but the paper presented by the said Swigert is the true last will and testament of said deceased.

It is therefore ordered and adjudged that the said paper presented by the said Innes be rejected and the said paper presented by the said Swigert is ordered to be recorded as the last

will and testament of the said Joseph Gore, deceased, whereupon the said will with this order is truly recorded in my office.
