In the name of God Amen, I Agnes Montague of Franklin County and State of Kentucky of lawful age being aged and weak in body, but of sound
mind memory and understanding, considering the certainty of death and the uncertainty of the times thereof and to the end that I may be the better
prepared to leave this world whenever it may please God to call me hence, do make and ordain this my last will and Testament, hereby revoking all
others in the manner following towit. It is my desire in the first place that my funeral expenses and my just debts should be paid out of my property.
For the second place it is my will and desire that after the payment aforesaid That my daughter Lucy Bagby wife of Nathaniel Bagby should receive
the sum of six shillings lawful money of this commonwealth. And thirdly that my daughter Elizabeth A. Endicott wife of Samuel Endicott should
receive the like sum of six shillings lawful money, fourthly that my son Thomas Montague should receive the like sum of six shillings lawful money
and fifthly that my daughter Polly Todd wife of George Todd should receive the like sum of six shillings lawful money as aforesaid. Sixthly that all
the rest of my property real personal and mixed shall go to and be invested after my death in my Grand daughters, Martha Ann Todd, Elizabeth
Smith Todd, Agnes Haley Todd, and Mary Jane Todd children of my daughter Polly Todd and son in law George Todd to be equally divided between
them and to be held by them and their heirs forever, provided however that if either of my said grand daughters shall die without issue then the proportion
of her or their so dying issue shall go and become the property of the survivor or survivors. The property refered to in this my last will and testament
consisting of the following parcels towit: a tract or parcel of land situate in the County of Jefferson and state aforesaid adjoining the land of William
Scarets and purchased of Thomas Reynolds by my lamented daughter Ann B. Montague and devised by her to me containing about sixty nine and one
half acres, also a negro boy slave named Anthony, four hundred dollars in money now in the hands of Mr. Joseph Taylor together with sundry articles
of household furniture all of which parcels of property as aforesaid I do by this my last will and Testament and in obedience to the request of my deceased
Daughter Ann B. Montague bequeath unto my said grand daughters Martha Ann Todd, Elizabeth Smith Todd, Agnes Haley Todd, and Mary Jane Todd as
aforesaid. It is my desire also that the said property real personal & mixed shall remain in the care and use of my son in law George Todd free from charge
until my Grand Daughters & devisees as aforesaid shall marry or attain to the age of twenty one years at which time or times they shall respectively receive
their due proportion of the property herein devised. And lastly I do appoint my said son in law George Todd and my friend Peter Dudley my sole Executors
for the execution of the aforesaid premises.
In testimony whereof I have hereunto signed sealed and acknowledged the same this 9th day of July 1823.
