Declaration


In order to obtain the benefit of the act of Congress of the 7th of June 1832.

On the 20th day of May 1833 personally appeared before the Justices of the County Court of Jessamine, William Fain, a resident of Jessamine County in Kentucky, aged 93 years, who being first duly sworn according to law, doth on his oath make the following declaration in order to obtain the benefit of the provisions made by the act of Congress passed June 7th 1832.

That he was drafted as a malitia man in the Revolutionary War in the year 1781 and served with Capt Li-- Shelton some time in the month of September and was marched and joined the regular army under the command of General Washington. From the advanced age and infirmed state of this claimant’s memory, he is unable to remember to names of all the field officers, nor the regiment or line in which he served, but he is prepared to prove, by the certificate of George Stults and Richard Fain, here referred to and made a part of this declaration marked A, that he was at the Seige of Yorktown and served three months tour and was regularly discharged.

He herein does not recollect by whom his discharge was given as it is lost. This declarant further states that at the time he was drafted, he was a resident of Patrick County, Virginia. He hereby relinquishes every claim whatever to a pension or an annuity except the present, and he declares that his name is not on the pension roll of any agency in any state.

We, Jacob Rohrer, a clergyman residing in the County of Jessamine, and James Irvine, residing in same county, hereby certify that we are well acquainted with William Fain who has subscribed and sworn to the above declaration. That we believe him to be ninety-three years of age, that he is reputed and believed in the neighborhood where he resides to have been a soldier of the Revolution, and that we concur in that opinion.

And the said court do hereby declare that interrogatories were put for the above declaration and that Jacob Rohrer, a clergyman, and James Irvine are both residents of Jessamine, and men of credibility, and that in their opinion, the above named applicant was a soldier of the Revolution and served as he states.

And the said court do hereby declare their opinion after the investigation of the matter, and after putting the interrogatories prescribed by the War Department, that the above named applicant was a Revolutionary soldier and served as he states. And the court further certifies that is appears to them that Jacob Rohrer, who has signed the preceding certificate, is a clergyman resident on Jessamine County, and that James Irvine, who has also signed the same, is a resident in the said county and is a credible person, and that their statement is entitled to credit.

I, Daniel B. Price, Clerk of the County Court for the County of Jessamine, do hereby certify that the foregoing contains the original proceedings of said court in the matter of the application of William Fain for a pension. In testimony whereof I have hereunto set my hand and seal of office this 20th day of May 1833.
