In the name of God Amen. I, Robert Smither, now of the county of Franklin and state of Kentucky being infirm of body, but of sound and disposing mind, do make and ordain this my last will and testament. Item 1st. I wish my body decently interred and the expenses thereon and defrayed out of my property. Item 2nd. I give and bequeath my bed, five bed quilts, two bed spreads, 3 sheets, one upholster, two pillows, 3 pillow slips, one teaster bedsted ___ bottom, three red curtains and all other things belonging to my bed to Olethia and Oplelia Malcom, twin daughters of Ann Malcom. Item 3rd. I give and bequeath to Nancy Webster, wife of Andrew Webster, my riding mare to be kept for her own use and benefit and I wish her to be bred and the colt given to Frances, George and Victoria Webster. Item 4th. I give to Andrew Webster, my part of a claim I now have to a negro boy in Washington County, named John Murry, now in the hands of Lewis Suggett, which he is to attend to and settle up for one half. Item 5th. I give and bequest to Mary Webster, daughter of Andrew Webster, all of my interest in and to a certain tract or parcel of land lying in the counties of Kenhawa and Mason in the state of Virginia, the papers of owning the above named claim now being in part in the hands of F. H. Hodges, which he is to attend and settle up for one half, and if he does not choose to settle it then whole claim I wish to be given to Mary Webster. Item 6th. I wish William Henry Smither of Owen County and Dr. A. Quarles to divide my instruments in dental surgery into two equal parts as near as can be in value, one half I wish to be given to the above named William Henry Smither by his paying to Andrew Webster one third of what he the said William Henry Smither may think the said half is worth, the other half I wish sold and the proceeds given to Andrew Webster. Item 7th I give and bequeath unto Andrew Webster all the balance of my estate both real, personal and mixed that is not above especially bequeathed and I wish him to collect all the debts due me and divide the money amongst his children. Item 8th I leave Andrew Webster and F. H. Hodges my executors and I do not wish them __ to the trouble of giving security as my estate is small and I have not doubt they will act faithfully. In testimony where of I have hereunto set my hand and seal this 7th day of August, 1846.
