Will Book 2

1824 - 1854

Page 20
I, Mary Rennick of the Town of Frankfort & County of Franklin in the Commonwealth of Kentucky do make ordain & publish this my last will & Testament,
whilst my mind is sound & capable to direct my desires and intentions in this behalf.
First of all I desire to explain the reasons upon which I act in making the dispositions herein after expressed hoping my will and desire may be thereby
more clearly understood and carried into effect. As the law seem to be more intent to provide for the accumulation of wealthy in a few hands that to make
provision for the support of the helpless woman or the education of the children, I am therefore intent on my part to take care of the helpless and infant
children of my good son Alexander H. Rennick and family believe that my said son will not ascribe to me any want of affection for him so far as I have any
worldly Estate to dispose of.
I design to appropriate it to the support and decent education of the children of my said born and to be born by his present or any other wife to be applied
to their sustenance and comfort & education during their infancy and as they respectively arrive at full age they to have such share as my Executor and
trustee may Judge prudent to distribute.  I am advised by Counsel learned in the law that I have full power and authority by this my will and Testament
to select a Trustee or Trustees of my own approval to declare my intent of the Trusts and that by so doing the law will protect those Trust & declared
intentions and Guard the Property from being taken or appropriated to other uses.  My first desire is therefore that all my just &  lawful debts be paid & do
hereby direct my executor and Trustees hereinafter named to cause the same to be paid out of my Estate either real or personal or of both - not meaning
hereby to give to fraudulent claimants any advantage to receive old and dormant claims barred in the Law.
Secondly I give & bequeath unto my Trustee and Executor herein after named my negro woman Milly & her child Mary and all their future increase and all
my lands & estate of every description real personal or mixed whereof I may die possessed or entitle in any way to him and his heirs forever in trust to pay
my debts (if any) according to the first bequest aforegoing and to dispose of the yearly proceeds or value of the residue to the use sustenance comfort &
education (during the infancy) of my grand-children Mary Willis Rennick, Eliza Caroline Rennick and Catharine Ann Rennick who are now born and such
others as may be born at any time after the date hereof of my son Alexander H. Rennick by his presents or any other wife and in trust more over, and I
give him full power as each or any child shall arrive at full age to give to such child after such mature age such part of my said Estate or the proceeds
unexpected as my said Trustee and Executor may judge fit & prudent to be spared and distributed without injustice to other children who are intended
hereby to have a part of my Estate.
Thirdly, I give my Executor and Trustee full power and authority to sell and dispose of all or any part of my Estate from time to time and apply the proceeds
to the objects of the trust before declared and to convert the same into other property to be held in trust for the purposes herein before & after declared &
directed.
Fourthly, my desire and intent is that my Trustee shall as near as may be (without being hindered from making suitable distributions of part as the children
arrive at full age) divide the Estate equally amongst all my grandchildren provided for in the second article of this my will.  If any child shall die under age and
unmarried and without Issue his or her share to for the benefit of the other children.
Fifth, In selecting a trustee to perform the objects of my will and the Trusts before declared I know of no one in whom I aught to repose more confidence than
in my son & the father of the children I have intended to provide for.  I do therefore constitute & appoint my son Alexander H. Rennick the Trustee and Executor
of this my last will and Testament to take and receive the estate to the purposes uses & trusts in this my will before & herein after declared and to such uses
& purposes only hereby forbidding him to apply or suffer to be applied the property or proceeds or any part thereof to his Own uses except for the legacy
expressly given to him to himself.
Fifth, I give and bequeath to my said son Alexander H. Rennick one gold ring (to be paid for out of my estate) as a token of a mothers affection & love hereby
declaring that in disposing of my property to his children instead of to himself, I have not been moved thereto by any want of affection; but because I have
reflected seriously upon the helpless condition in which his wife & children would be were he suddenly taken from this world.
Lastly, I desire and will that my said Executor shall not be required to give any security as Executor, or as Trustee of this my will.
In Testimony that his is my last will & Testament and revocation of all former wills or Testaments I have hereunto set my name & published it as such before
witnesses.  Done this twenty first day of June in the year one thousand eight hundred and twenty seven.
