In the name of God Amen. I James Smart of the County of Franklin and State of Kentucky lying on my sick be and being low in body but of sound mind and perfect recollection,
thanking God always for the many blessings bestowed upon me.  Do in the presents of God and these witnesses make this my last will and testament in the following words
and form (towit).
1st That my funeral expenses and all of my just debts be legally discharged. 2. It is my wish and desire that my two grand children James Smart and Rebecca Smart children
of my son John H. Smart have paid to each of them by my executor out of my estate the sum of twenty five dollars to each of them. 3rd. It is further my wish and desire that
my daughter Elizabeth Smart wife of Thomas L. Smart have paid to him my executor the sum of one dollar.  4th. It is further my wish and desire that my grand daughter Mary
S. McBride for her kindness and attention to me in my old days, have the sorrel colt of mine, which has usually been claimed by her and one womens saddle which she has
used as her own for some time past, this colt and saddle is a gift over and above her brothers and sisters.  5th It is my wish and desire that my executor emancipate and set
free agreeable to the laws of Kentucky my man servant David as soon as he the sd. servant David shall pay or cause to be paid over to my executor with what he has already
paid and I have received, which sums is known by John D. Richardson and E. S. Coleman two hundred and forty nine dollars.  6th It is further my wish and desire that the
balance of my estate be equally divided into three parts my son Henry F. Smart to one part my daughter Lucy Green wife of Elijah Green and my grandson Granville W. Smart
to have another part equally divided between them too, and my four grand children (towit) James McBride, William McBride, Mary S. McBride and Lucinda McBride to have
the third part equally divided between the last four named.  7th It is further my wish and desire that my son Henry T. Smart should act as executor to this my last will and
testament where unto I have affixed my mark this eight day of December in the year of our Lord eighteen hundred and thirty two.
