In the name of God Amen. I, Charles Tyler of the county of Franklin and state of Kentucky being advanced in years, yet of sound mind and disposing memory for which I hereby desire to return thanks to God. Mindful of the great uncertainty of life and desire to dispose of such property as it has pleased God to bestow on me, do give and bequeath the same in the following manner, viz: having a sincere desire to act justly and impartially to all who have a natural right to expect any portion of my estate and having had six children of whom four are now living and two of whom died leaving issue. It is my desire that my estate be divided unto six equal parts with the exception hereafter to be mentioned and that it be distributed in the following proportions. It is my will that immediately after my death all the perishable part of my property, my stock and household furniture be sold and out of the moneys arising from such sale my just debts and funeral expenses are to be paid. The residue of my estate whether in money, bonds, notes or otherwise to be distributed as follows, viz: 1st. I give to my son Alfred F. Tyler one sixth part. 2nd. I give to my son Norvell D. Tyler on sixth part. 3rd. I give to my son-in-law, Chapman Harrod and Nancy, his wife, one sixth part. 4th. I give my daughter Susan? Ann Tyler one sixth part. 5th. I give to John Tyler and Charles Tyler, sons of my deceased son, William, and to be equally divided between them one sixth part with the exception of forty dollars, which is to be taken from this share and to be given to Frances Marion Tyler. 6th. I give to Charles Thomas Tyler, Malinda Ann Tyler, Francis Marion Tyler and George Obediah Tyler, children of my deceased daughter Malinda, one sixth part to be equally divided between them. 7th. I give to my grandson, Francis Marion Tyler the further sum of forty dollars to be taken as above directed the share of John and Charles Tyler. And it is moreover my will that my children shall take their share as soon after my death as my executors can make the necessary arrangements of my affairs so as to enable them to mae the division, and it is my will that my grand children shall take their proportions as they respectfully attain the age of twenty one years. And lastly, I do hereby constitute and appoint my friend Orlando Brown and Mason Brown executors of this my will and testament. In witness whereof I have hereunto set my hand and affix my seal this seventh day of February in the year of our Lord eighteen hundred and thirty seven. Charles Tyler
