I, Charles Riley Penn of the City of Frankfort and state of Kentucky do hereby make and publish my last will and testament as follows: First, I direct the payment of all my just debts and funeral expenses and under the the term penalty expenses. I mean to include the wish of erecting over my grave a suitable monument at the discretion and according to the view of my executor. Second, I direct that all my property of every kind and description shall be sold at public or private sale, as my executor shall in his discretion deem best and upon such credits and terms as said executor may consider advisable and that the debts owing to me, whether by note, bond account or otherwise shall be collected so far as it can be done, which whenso collected, including all the money raised by the sale of my property as also the money on hand at my death, I dispose of as follows: To Susan Penn, widow of my deceased brother, William Penn, I give three hundred dollars, to Mary Robertson, cousin of the above named Susan Penn and now living with her, I give one hundred dollars. All that remain after the payment of my just debts and funeral expenses and the above legacies. I give to my sister Jane Smither, widow of William Smither, deceased and I hereby constitute and appoint Richard Gillispie of the City of Frankfort my sole executor of this my last will and testament, April 2, 1855.
