1834 Deed Chilton Allen to James Lowrey This Indenture made and entered into this 2nd day of August 1834 between Chilton Allen of the one part and James Lowrey of the other part Witnesseth said Allen for the consideration of one dollar in hand paid hath granted bargained and sold and by these precincts doth grant bargain and sell all his right title part and interest in and to fifty acres of land in Clarke County on Red River and bounded as follows to writ, Beginning at the mouth of log lick creek on the North bank of said River thence down with the meanders thereof N9 E nine poles thence N70 W34 poles thence N 84 W80 poles to an elm and horn beam in Austins line thence with said line N74 E240 poles to a black oak and white oak corner to John Ervin thence N29 W37 poles to a white oak thence S44 � W69 poles to the beginning containing 50 acres to have and to hold the interest of said Allen in the same to said Lowrey and his heirs forever . In witness whereof said Allen hath hereunto set his hand & seal this day & date above It is fully understood that a life estate is reserved out of the above described tract to Lineford Lowry MOTHER to said James it being the same part on which she now lives and is in her possession. Where upon said deed together with the foregoing certificate hath been duly admitted to record in my office Given under my hand this 2nd day of Augt 1834 Exd James O Bullock Clk Source: James Lowry from Chilton Allen, Clark Co., Kentucky, Deed Book 26, Page 479. 1845 Deed - Thomas Lowery Sen to William Lowery (Deed Book 32 Page 167) : This indenture made this 20th day of May 1845 between Thomas Lowery Sen of County of Clarke and Commonwealth of Kentucky of the one part and William Lowery of the other part witnesseth that the said Thomas Lowery for and in consideration of the love and natural affection that I have for my son William Lowery and for his care and support of me and my wife Nancy Lowery for and during our natural lives agreed to by the parties at and before the sealing of these presents which agreement I do hereby acknowledge have bargained sold and granted and confirmed and by these presents (and the conditions as hereafter named) do bargain sell grant and confirm to the said William Lowery his heirs or assigns all that tract of parcel of land situated and being in the County of Clarke and on the waters of Lulbegrud Creek and bounded as to wit: Beginning at a stone corner to James Lowery at the fork of the Ervin and Ewells mill road thence with said Jas Lowery line N53 E75 to a stone corner in the edge of Lulbergrud Creek thence down the creek S56 E78 poles to a sugar tree on the bank of said creek comes to George Watts thence with his line South7 E22 poles to a white oak thence S16.30" W19 poles to a small popular on the cliff thence S6 W51 1/2 poles to a small red oak near Watts meadow thence S76.15" W22 poles to a dogwood & stone come on the leading to Ewells mill ad thence meandering to same N42 W18 poles thence N75 W24 poles thence N41 W28 poles thence N18 W26 poles thence N46 W16 poles to the beginning Supposed to contain seventy two acres one rod and 32 poles be their the same more or less Together with all and singular the appurtenances there unto belonging or ___ in any ___ ___ to have and hold the land ___ conveyed with the appurtenances unto the said William Lowery his heirs or assigns against the claim or claims of all and every person or persons whatever doth and will forever warrant and defend by these presents in witnesseth whereof the said Thomas Lowery together with Nancy Lowery his wife who hereby relinquishes her right of dower in and to the land conveyed by this deed provided always and it is expressly understood between the parties that the said Thomas Lowery and Nancy Lowery is to remain on the aforesaid tract of land and premises and have full control of the same so for as they may wish for and during their natural lives but the said William Lowery is to have the profits of the same after furnishing the said Thomas Lowery and Nancy Lowery & family with all necessary food for the consumption of the family as aforesaid and with all the necessary firewood and fires made and at the death of said Thomas Lowery is to be invested with a full and perfect right in and to the land hereby conveyed by his performing the conditions as aforesaid --- In testimony whereof they have hereunto set heir hand and affixed their seals this day and date first above written [interlineations made before signing edge of creek and fires made] Attest William C Cooper P Bush State of Kentucky Clarke County I James W Bullock Clerk of the County Court for the county aforesaid do certify that this deed from Thomas Lowery and Nancy his wife to William Lowery was this day produced to me in my office and proven according to law by the oath of Wm C Cooper and Pleasant Bush witnesseths there to subscribed to be the act and deed together with the forgoing Certificate hat been duly admitted to record in my office under my hand this 23rd day of June 1845 Att James W Bullock CCC By James P Bullock DCC 1848 Deed - William Lowry from Thomas Lowry Heirs (Deed Book 23 Page 188); Deed delivered to owner Sept 3rd 1850: This is indenture made and entered into this 10th day of March in the year of our Lord 1848 by and between Anderson Lowry and Catharine his wife Edmund Carr and Nancy his wife Garnett Lowry and Matilda his wife John Niblack and Louisa his wife of the County of Clarke and State of Kentucky and Jacob Fritts and Jane his wife and Thomas Lowry and Nelly his wife of the County of Madison and State aforesaid party hereto of the first part and William Lowry of the County of Clarke and state aforesaid of the second part witnesseth that the aforesaid party hereto of the first part for and inconsideration of the following sums of money to wit thirty dollars to the aforesaid Anderson Lowry thirty dollars to the aforesaid Edmund Carr and Nancy his wife, thirty dollars to aforesaid Garnett Lowry, thirty dollars to the said John Niblack and Lousia his wife, twenty dollars to the said Jacob Fritts and Jane his wife and the like sum of twenty to the said Thomas Lowry which several sums of money has been paid to others ___ as herein before named by the said William Lowry, the receipt of which is acknowledged by the party hereto of the first part, the party hereto of the first part have granted bargained and sold and by these presents do hereby grant bargain sell and release and convey unto the said William Lowry party hereto of the second part, all of their undivided interest in and to a certain tract or parcel of land situated lying and being in the said County of Clarke and State aforesaid on the water of Red River, said tract supposed to contain 54and an half acres, it being the same tract or parcel of land conveyed to Thomas Lowry by Geo Graham, Andrew Ramsey and Catharine Ramsey by Chilton Allen their agent by a deed of conveyance dated on the 30th day of July 1828 and was of record in the Clerks Office of the County Court, and it being the same land Jasper R Todd now has in his possession as tenant of Nancy Lowry widow of said Thomas Lowry now deceased and it being a part of the land that aforesaid Thomas Lowry owned in his life time and ___ to the said Nancy Lowry his widow for and during her natural life, then the same to belong to this children, said will is now of record in the Clerks Office aforesaid, they the aforesaid Anderson Lowry, Nancy Carr, Garnett Lowry, Louisa Niblack, Jane Fritts and Thomas Lowry being children of said testator Thomas Lowry and also the party hereto of the first part for the consideration aforesaid do hereby sell transfer and assign to him the aforesaid William Lowry all, interest claim and demand which they or either of them have or may have as children and desires or heirs at law of the said testator Thomas Lowry in and to the personal estate , money and chooses in action ___ belong to them under said will the interest hereby sold and intended to be conveyed is the one undivided seventh part in and to said land and other property herein before named which belong to the party of the first part, to have and to hold said undivided interest in and to said land and other property to him the said William Lowry and his heirs and assigns forever, and the party hereto of the first part do & will ___for the under and their heirs executors and administrators forever warrant and defend the title hereby conveyed by them unto him the aforesaid William Lowry and his heirs and assigns free from all claim or claims of them the party hereto of the first part and free from all claim or claims whatsoever In testimony whereof the said Anderson Lowry and Catharine his wife, Edmund Carr and Nancy his wife Garnett Lowry and Matilda his wife John Niblack and Louisa his wife, Jacob Fritts and Jane his wife and Thomas Lowry and Nelly his wife have hereunto subscribed their names and affixed their seals the day & year first ___ written Witnesseth Dudley Stone John W Lougnecker Garnett Lowry (seal) Matilda Lowry (seal) Anderson Lowery (seal) Catharine (X her mark) Lowry (seal) E C Kerr (seal) Nancy Kerr (seal) Jacob Fritts (seal) Jane Fritts (seal) Nelly Lowry (seal) Thomas Lowry (seal) Kentucky Clarke County pct We Pleasant Bush and William B Keas two of the Commonwealth Justices of the peace for said County do certify that Catharine Lowry the wife of the written named Anderson Lowry this day personally appeared before us who being examined privily and apart from her husband as the law directs voluntarily with her own free will and consent relinquished their right of dower to the premises conveyed by this deed and wishes the same committed to record in the proper office. Bullock deputy clerk for James W Bullock clerk of the County Court for the County aforesaid do certify that this deed from Garnett Lowry and others to William Lowry was this day produced to me and acknowledged by the said Garnett Lowry & Matilda his wife to be their act and deed and the said Matilda being examined by me privily and apart from her said husband declared that she did freely and willingly signed and deliver said writing and wishes not to retract it and acknowledged said writing again ___ and explained to her to be her act and deed and ___ that the same may be recorded. Bullock CK And on the 26th March 1849 the same was produced to me Jas W Bullock clerk of said court and proven according to law by the oaths of Dudley Stone and Jno W Lougenecker witnesseth thereto subscribed to be the act and deed of Anderson Lowry, and on the 5th Oct 1849 the same is acknowledged by Jacob Fritts to be his act and deed, and on the 5th Dec 1849 the same is acknowledged by Edmund C Kerr to be his act and deed, and on the 25 of May 1849 Nancy Kerr wife of Edm' Kerr, and on the 5 Oct 1849 Jane Fritts wife of Jacob Fritts, and on 27th Oct 1849 Nelly Lowry wife of Thomas Lowry being examined by me (agreeably to the dates above) privily and apart from their said husbands declared that they did freely and willingly seal and deliver said writing and wishes not to retract, and acknowledged said writing again shown and explained that the same may be recorded, and on this day the same is acknowledged by Thomas Lowry to be his act and deed, whereupon the said deed together with the foregoing certificates hath been duly admitted to record in my office.
