State of Kentucky. Fleming County SA I William T. Dudley Clerk of the court for the aforesaid certify that the foregoing Deed and certificate were this day received in my office. And the same are together withthis certificate duly recorded. Given under my hand this 26th day of April 1858 W.T. Dudley-clk This indenture made this 1st day of May in the year Eighteen hundred and fifty eight between Samuel B.Lyons as Executor of Truman Day Dec'd of the County of Fleming and Stateof Ky of the one part and Joel Havens of the County and State aforesaid of the other part. Witnesseth that the said Samuel B.Lyons for and in consideration of $2603.75 in hand paid the Receipts whereof is hereby acknowledged hath granted bargained and sold and these presents doth grant bargain and sell unto the said Joel Havens his heirs and assigns that tract of land on which Truman Day Dec'd formerly lived in the County of Fleming Lying on the Licking River and bounded as follows, viz,Beginning at a stake near a shugar tree corner to Joel Havens in Edens line thence 5. 1/2 west 83 poles to a stake upon the Bath side of Licking thence west with Denton's line 259 2/10 poles to a stake upon the west bank of the River thence down the same N. 4 E. 65 1/2 poles to a stake thence n 30 west 37 poles to a stake upon the west bank between 2 sycamores oposite the mouth of a small branch thence crossing the river & up a branch as it meanders N 77 E. 69 poles N.66 E. 48 1/2 poles N77 East 40 poles to a large Elm thence 5. 74. E. 22 1/2 poles to a stake in said Havenses line corner to A. Grahams thence S 1 no 53 1/2 poles to a stake corner to said Havenses the~ce E. 99 3/4 poles to the beginning Containing one hundred & seventy three Acres 2 quarters & 13 poles.Together with all the improvements there into belong-ing. To have and to hold the land and premises hereby conveyed unto said Joel Havens & his heirs and assigns forever and the said party of the first part doth forever warrant and defend the aforesaid tract of Land unto the said party of the second part his heirs or assigns from all and every other claim or claims forever.
