This indenture made and entered into this the 16th day of August
1866, between R. B. Evans as commissioner an a
judgement of the Barren county court of the first part and James M.
Wyatt of the second part Witness to that where as at the April term
1866 of the Barren county Court in a suit pending there as in which
J. H. Steenbergen, Martha Britt, George
Britt, Joseph Wyatt, and Martha Wyatt
(widow) are plaintiffs against James M. Wyatt,
Rebecca Henderson, Thomas Henderson,
Mary Wyatt, Loanie Whitney,
and the unknown heirs of Sally McGinnis (deceased )
defendants.
A judgement was rendered by which it was ordered and adjudged that the lands
mentioned in said suit containing 225 acres be set apart in lots as follows;
to plaintiffs: J. H. Steenbergen one fourth and one eighth of
one fourth to plaintiff Joseph Wyatt the same to Plaintiff
Martha Britt and Martha
Wyatt each one eight of one fourth to defendant Mary
Wyatt, Rebecca Henderson, each one eighth of one
fourth and to the unknown heirs of Sally McGinnis ( deceased)
one eighth of one fourth of said land.
And W. Wright , K. P. Ellis and
G. A. Ellis we appointed commissioners to executors said
judgement and where as at the end term 1866 of said court said commissioners
filed their report in open court showing another thing that they allotted to
James M. Wyatt party of the second part lot # 8 containing 57
½ acres and bounded as follows; beginning at a black gum corner to lot #7 with
line of the same N 59 E 171 poles to a hickory and gum on the original line S
25 E 90 poles to hickory and black oak on the bank of Tracy Branch up the same
with meanders S40 W 32poles to a white oak Steenbergen corner W 156 poles to
the beginning. Said land lying and being in the county of Barren and State of
Kentucky on the waters of Peter’s Creek and whereas further at the July
term 1866 of said court a judgement was entered confirming the report of said
commissioners and appointing R. B. Evans a commissioner to
convey the land to the persons entitled thereto as shown by said report.
Now therefore in consideration of the promises and by virtue of the authority
vested in me as commissioner in said judgement, I do hereby for and on behalf
of the heirs at law of John Wyatt (deceased)
convey the daid land as herein described to said James M.
Wyatt. To have and to hold unto her and his hand and assigns
forever and I agree to warrant and defend the title to said land to be free
from all claims whatever so far as I am authorized and empowered by said
judgement to do. Given under my hand and seal the day and date first herein
written.

I, J. P. Nuckols clerk of the
county court for said county certify that the fore going deed from R.
B. Evans commissioner to James M. Wyatt was the
20th day of August 1866 acknowledge by said ___ to be his act and deed and
filed for record duly stamped and the same together with the approval of
W. R. McFerris county clerk judge endorsed thereon and the
certificate have been recorded.
